Executor of a Will in Malaysia

An executor is the person you appoint to carry out your will. They apply for the grant of probate, gather your assets, settle debts and taxes, and then distribute what remains to your beneficiaries.

The role is administrative and can take months. Choose someone organised, trustworthy and willing to take it on — and always ask them first.

Main duties

  • Locating the original will and applying for probate
  • Identifying and safeguarding estate assets
  • Settling outstanding debts and expenses
  • Keeping records of what was received and paid out
  • Distributing the estate according to the will

Choosing your executor

An executor should be an adult of sound mind. Many people appoint a spouse, adult child or sibling; a trust company can also be appointed where fees are acceptable to the family.

Naming a substitute executor is wise, in case your first choice cannot or will not act when the time comes.

Can an executor also be a beneficiary?

Yes. An executor may inherit under the will. The restriction that matters is on witnesses, not executors.
